1. Application

By submitting an order, you agree to these Terms of Sale, our Terms of Service, Shipping Policy, Return & Refund Policy, Privacy Policy and any product-specific terms displayed before purchase.

2. Product Listings

We make reasonable efforts to provide accurate product names, descriptions, photographs, dimensions, materials, prices and availability.

Minor differences may occur because of screen settings or normal production variation. If a material error affects an order, we may contact the customer, correct the listing or cancel and refund the affected order.

3. Orders and Acceptance

Adding a product to a shopping cart does not reserve it.

Submitting an order constitutes an offer to purchase. Receipt of an automated confirmation means that the order was received but does not necessarily mean that it has been finally accepted.

An order is accepted when it is approved for fulfillment or shipped.

4. Right to Reject or Cancel an Order

We may reject or cancel an order because of:

• Product unavailability;

• Incorrect product or pricing information;

• Payment failure;

• Suspected fraud;

• Shipping restrictions;

• Quantity limitations;

• Incorrect customer information; or

• Legal or regulatory requirements.

If payment has already been collected for a canceled order, the applicable amount will be refunded to the original payment method.

5. Price and Currency

Prices are displayed in U.S. dollars unless otherwise indicated.

The price charged is the price displayed during checkout, subject to correction of an obvious error. Applicable sales tax is calculated during checkout.

6. Payment

Payment is collected when the order is placed.

Available payment methods may include Visa, Mastercard, American Express, Discover, Diners Club, PayPal, Shop Pay, Apple Pay and Google Pay. Only methods shown during checkout are accepted.

You must be authorized to use the selected payment method.

7. Availability

Products and quantities are subject to availability. We do not guarantee that a product displayed on the website will remain available.

If a product becomes unavailable after purchase, we will contact the customer and provide an appropriate refund or available alternative.

8. Shipping and Delivery

Orders are shipped only within the contiguous United States.

Standard shipping is free. Orders normally require 1–3 business days for processing, followed by an estimated 3–7 business days for delivery.

Delivery dates are estimates and are subject to carrier and external delays. Complete details appear in our Shipping Policy.

9. Title and Risk of Loss

Title and risk of loss pass to the customer upon delivery, subject to applicable law and any claim for loss or damage properly submitted under our policies.

10. Inspection After Delivery

Inspect the order promptly after delivery.

Report damaged, defective, incorrect or incomplete products to support@tempehio.com and provide the order number and supporting photographs.

11. Product Use

Products must be installed and used according to their descriptions, instructions and warnings.

Unless expressly identified otherwise, TEMPEHIO lighting products are intended for dry indoor supplemental lighting and are not emergency lighting.

Customers are responsible for confirming product dimensions and compatibility before installation.

12. Returns, Exchanges and Refunds

Eligible products may be returned within 30 days after delivery in accordance with our Return & Refund Policy.

Approved returns receive a prepaid return shipping label. No restocking fee applies to a compliant approved return.

Approved refunds are issued to the original payment method within 5–10 business days after return inspection.

13. Order Changes and Cancellations

Contact us promptly if an order needs to be canceled or changed. We will try to process the request before fulfillment, but cancellation or modification is not guaranteed.

After shipment, the regular return procedure applies.

14. Warranties and Consumer Rights

Products are covered by warranties expressly stated on the applicable product page, if any.

Nothing in these Terms excludes warranties, rights or remedies that cannot legally be excluded.

15. Limitation of Liability

To the fullest extent permitted by law, TEMPEHIO LLC is not liable for indirect, incidental, special or consequential losses.

Our aggregate liability concerning a product will not exceed the amount paid for that product, except where applicable law requires a different remedy.

16. Governing Law

These Terms of Sale are governed by the laws of the State of Missouri, without regard to conflict-of-law principles.

The parties agree to make a reasonable good-faith attempt to resolve disputes through customer service and informal discussion before initiating legal proceedings.

Nothing in this section limits any mandatory consumer right or venue protection.

17. Severability

If any part of these Terms is found unenforceable, the remaining provisions will continue in effect.

18. Changes

The Terms in effect when an order is submitted generally apply to that order. We may update these Terms prospectively by publishing a revised version on the website.
